The National Curriculum-Framework - MUT's reaction

This afternoon the MUT held a press conference to present its reaction about the proposed National Curriculum Framework. This document is based on the consultation process with teaching grades carried out by the Education Committee. The Union would like to thank all teaching grades, teacher associations and groups who participated in the consultation process. MUT writes to DQSE in connection with Afternoon Courses

The MUT has today written to the DG DQSE to consider teaching grades the option to attend courses in different colleges if they are unable to attend those in their own college on account of personal reasons. The MUT is also asking the DQSE to keep up the good practice of offering child minding services during these courses. The Union has also requested the DQSE to provide a viable option for teaching grades who cannot attend afternoon sessions due to humanitarian reasons.

In-Service Courses within the school year

The Union would like to clarify that during the 2007 sectorial agreement negotiations a reform of the in service courses was undertaken, whereby it was agreed that once in every two years teaching grades may be asked to attend an in-service course during the school year.

This is done on two conditions (following submissions and clarifications agreed upon in 2010):
a) That these courses replace those done in summer
b) These courses have exactly the same amount of hours as those done in summer.
c) That such courses may only be enforced on teaching grades on a biennial basis.

The Union would like to point out that surveys carried out both by the Union as well as by the Education authorities, showed that the majority of teachers wanted a reform in the summer in-service courses for a variety of reasons, including the fact that course work could not be applied in practice when these courses are done in summer. Other reasons that emerged included the fact that summer courses were very often ineffective and carried out in an unsuitable environment.

The MUT would also like to point out that during the last agreement (2010) the set up of these courses was redefined and re-dimensioned on insistence of the Union and parameters mentioned above were introduced. Members must appreciate that sectorial agreements are negotiated between the various Government units and the Union. The last sectorial agreement included new achievements for all including bridging provisions, better allowances, the concept of reduced hours, cross sectional promotional avenues, the confirmation of school times and conditions, new opportunities for promotion and various other details.


E Learning Platform

The MUT would like to clarify that there is no agreement reached between the MUT and the Government on the use of the elearning platform by teachers / KGAs / LSAs or any other teaching grade. This applies for both state schools as well as Church schools. Teaching grades who are already using some elearning concepts are doing so on their own initiative and there is no obligation for anyone to follow suit. Teaching grades who have been coerced or forced to use any sort of elearning platform are to inform the Union immediately for direction.

In the mean time discussions are still underway and training of staff has already commenced. The Union is monitoring all the developments and the MUT Council will take a position when all the details are clear. While the Union recognises the need for advancement, the MUT will be ensuring that this platform does not have any implications on working conditions.


Civil Service Collective Agreement

The MUT will be involved in an inter union meeting today. During this meeting several issues concerning the Unions covering civil servants will be discussed. Civil Service CA talks will be continuing this week with Hon. Minister Tonio Fenech, Dr. Godwin Grima (PPS) and PACBU.

Case of LSA in resource room


In an urgent meeting convened yesterday by the Permanent Secretary, the MUT has been informed by the Director General DES that upon her instructions the LSA in question was not informed about the situation. The Union has been informed that the Head of the particular school stuck to the orders given by the Director General. In the mean time the case is under investigation of the authorities.

During the meeting the MUT made it clear that the directives issued for LSAs were there to stay and they would only be lifted if there is an agreement between the DES and the MUT on procedures to be used. As explained previously the Union had issued the directives in question to protect both its members as well as the children involved in such situations.

Therefore the MUT is asking all LSAs to stick to the directives given and refrain from being in a resource room and/or other activity room alone with one child unless there is the presence of at least one other responsible adult.

Dear Members,

Following an amendment to the MUT statute carried out by delegates during the Triennal General Conference held in May 2011, the Union will be issuing nominations for members to join its Youth Section with the aim of establishing it by January 2012.

The MUT Youth Section will be composed of young members aged 18 to 35 and aims to:
" empower young union members
" rally young members with a common interest
" magnify young members' voices
" share young members' experiences
" contribute to a smooth school to work transition
" enable young members to access the union structures
" critically and constructively think about, debate and bring forward important issues
" put forward the benefits of a trade union membership
" organise young members at the workplace
" ensure that young member's issues are reflected in trade union policies and programs
" co-operate with other unions and organisations to establish good networking
" provide special services and publications for young members
" be an initial spark for new union initiatives


The MUT Youth Section will also present opportunities for members to participate in local and European fora, programmes and initiatives through the MUT's present affiliations and new affiliations of the MUT Youth Section.

This morning the Curriculum Management and E-Learning Department within the Directorate for Quality and Standards in Educational held a briefing session for school leaders in view of Phase 1 of the Training schedule for the Fronter information management system (E-Learning Platform). During the said meeting, which was also addressed by Mr. Raymond J. Camilleri, Director Curriculum Management and elearning, it was explained that the Directorate will be making arrangements on a one-to-one basis for teaching grades who cannot attend the scheduled sessions for valid reasons. Teaching grades who cannot attend the scheduled training sessions are therefore urged to contact the Directorate. The Union would like to thank the DQSE for considering its claims and for providing alternative arrangements for teaching grades to attend training.

MUT COUNCIL ELECTIONS 2011 - 2014: The Election Board notifies that the electoral process is now complete. The full list of votes polled by each candidate, showing the elected members of Council is attached to this Circular.

The Election Board congratulates the President-elect, Mr Kevin Bonello, and the elected Council Members and wishes them a fruitful term of office. On behalf of the MUT Secretariat, the undersigned augurs Mr Bonello all the very best at the helm of the MUT.

In the meantime, on behalf of the MUT Administration, the undersigned would like to thank Mr Bencini for his dedicated work as MUT President between 1996-2011 and wish him well in his future endeavours.


ELECTION OF MUT OFFICIALS:
The Vice-Presidents of the Union and other Officials will be elected during the first meeting/s of the MUT Council as per MUT Code of Rules. The names of the elected officials will be publicised following their election.


MUT BIENNIAL GENERAL CONFERENCE 2011:
The MUT Triennial General Conference was held at Le Meridien Hotel, St Julians on the 30th May 2011. Mr Rizsard Proska, President of Solidarnosc, delivered the keynote presentation. Mr Proska spoke about the Polish Education System, in particular the transition from one level of education to the next. A number of amendments to Statute and motions were presented for the Conference's vote. The amendments to statute and the motions approved in the conference will be reproduced in the next edition of The Teacher.

Mr John Bencini, MUT President, delivered the concluding address. In his speech, Mr Bencini addressed the major challenges faced by the local education sector and highlighted . At the end of his speech, Mr Bencini was greeted with a standing ovation in recognition of his sterling work as President over the last 15 years. Following the passing of a motion in the General Conference, Mr Bencini was offered an Honorary Presidency and Advisory role. This decision was later communicated to Mr Bencini who thanked the Union for the honour. Mr Bencini accepted the Advisory role but declined the Honorary Presidency in order not to posit any conflict of interest.

The Conference was very well attended and there was active participation by Delegates in the ensuing discussions. The MUT thanks all Delegates for their participation in the Conference and their active involvement in the life of the Union.

A full report of the General Conference will be published in the next edition of "The Teacher".

COLLEGE SYSTEM SURVEY: The Survey Research commissioned by the MUT into the College System is in full swing. The study is being conducted by Prof Mark Borg and Dr Joseph Giordmaina, assisted by Dr Anthony Vella.

EXHIBITION AT ITALIAN CULTURAL INSTITUTE: Teachers and their friends are invited to visit an exhibition at the Italian Cultural Institute St. George's Square, Valletta entitled 'Roman City Melite'. Opening time is between 9.00 a.m and 1.00 p.m. until Saturday, 2nd July 2011.


TEACHERS' INSTITUTE OFFICE HOURS (Summer Recess): During the Summer Recess in Schools, i.e. from Monday, 11 July to Friday, 16 September (both days inclusive) the Teachers' Institute will be open from 8.00a.m to 1.00 p.m. with the exception of three weeks shutdown in August. The Teachers' Institute will be closed between Monday 1st and Friday 19th August 2011 (both days inclusive).

Members are reminded that during this period, the MUT Secretariat and the Union's officials will be utilizing some of their vacation leave entitlement and the offices will be run with a reduced complement of staff. Members' cooperation and understanding during these weeks will be greatly appreciated.

It is strongly recommended that members who may wish to avail themselves of the Union's services during the summer period ensure that they set up an appointment in advance so as to avoid disappointment.

Church Schools Agreement Signed: The Malta Union of Teachers and the Secretariat for Catholic Education have concluded an agreement on the conditions of teaching grades employed with Church Schools.

This Agreement parallels the conditions of teaching grades in state schools established in the state education sectoral agreement signed between the MUT and the Government of Malta in August 2010.

A meeting on the new Agreement for teaching grades in Church Schools will be held on the 8th June 2011 at The Teachers' Institute at 3.00pm.

MUT Declares Trade Dispute at MCAST: The MUT has declared a trade-dispute with MCAST concerning a number of outstanding issues, namely: the position of MCAST Learning Support Assistants (LSAs), part-time members of staff being requested to assume self-employed status, progression of lecturing staff and unclear management guidance on the taxation status of employees providing lecturing services with MCAST Gateway to Industry.

The MUT Council will be meeting to decide the course of action to be taken.

MUT TRIENNIAL GENERAL CONFERENCE - 2011

As already advised the MUT Triennial General Conference will be held at Le Meridien Hotel, Balluta on the 30th May 2011. The following are the Amendments to Statute and Motions received at the MUT Secretariat as per our call:


MUT COUNCIL AMENDMENTS TO STATUTE AND MOTIONS FOR APPROVAL OF THE GENERAL CONFERENCE 2011:


Amendments to Statute

1) To Amend:

Council 16 (h)
Any member of the MUT Council who becomes a full-time official in the Confederation of Malta Trade Unions will be required to relinquish his seat on Council until such time as he/she is performing duties with the Confederation.

To Read:

Any member of the MUT Council who becomes a full-time official of any Confederation of Trade-Unions will be required to relinquish his seat on Council until such time as he/she is performing duties with the Confederation.


ERRATA CORRIGE:

Any member of the MUT Council who becomes a full-time official of any Confederation/Association of Trade Unions will be required to relignquish his seat on Council until such time as he/she is performig duties with the Confederation/Association.


2) To ADD Clause and AMEND subsequent numbering:

79) Legal Services offered to MUT Members:

1. MUT members shall be entitled to free verbal legal advice on any matter.
2. Fully paid MUT Members shall also be entitled to free legal representation on issues whereby they:
a. are affected by a clear breach of a collective agreement signed by the MUT, and/or
b. are facing disciplinary procedures that may lead to dismissal, and/or
c. need legal representation on the Industrial Tribunal on issues as listed above related to their employment within an education setting.

Further to sub-clause 2 above, the MUT Council may consider the granting of free legal representation to members on other issues related to employment that are not listed above.

4) ADD: SECTION XV:

MUT YOUTH SECTION

81 The MUT shall have a Youth Section as per provisions herein established.

(1) Recruitment and elections of MUT YOUTH Section Committee members

Young MUT members who are between 18 and 35 years old and who pay their subscription fee regularly are eligible to join the committee. A call (for nine members) will be made in conjunction with the MUT Council Elections or when the MUT Council deems fit for the interim period. A nomination form will be made available online on the MUT website. A hard copy of the nomination form will also be sent to members through a letter circular issued to schools and other educational institutions by the union. Duly filled nomination forms can be sent by post to the MUT or delivered personally by hand or through the union delegates/representatives.

An electoral board which will be appointed by the Union will process nominations and hold an ad hoc election if applicable.

(2) Composition of MUT YOUTH Section Committee:

" MUT Youth will consist of a maximum of eleven regularly paying MUT members;
" The term of the committee will be three years;
" Committee members will be aged 18 to 35 years old when they are nominated;
" The committee will be composed of a chairperson, a deputy chairperson a secretary and eight members;
" Up to two MUT Youth members will be nominated by the MUT council. At least one of these members will be required to assume the role of either the chairperson or the deputy chairperson of MUT Youth.
" Other members of MUT Youth will be nominated and seconded by MUT members;
" An election for nine committee members will be held if the number of nominees (except the two members nominated by the council) exceeds nine;
" If applicable, elections will be held simultaneously with the MUT council election,


(3) Aims and Objectives of MUT YOUTH Section:
" empower young union members
" rally young members with a common interest
" magnify young members' voices
" share young members' experiences
" contribute to a smooth school to work transition
" enable young members to access the union structures
" critically and constructively think about, debate and bring forward important issues

Council Motions:

1. Funds and Research:

The Union Council, under the guidance of the MUT Treasurer, will endeavour to seek methods of tapping European funds for research purposes with the objective of embarking on research projects which can help shape and guide Union policy on matters that concern the MUT.

3. Consultations with the MUT:

The General Conference appeals to the Education Authorities to practice the principle of social dialogue at all levels and stages of policy making. The General Conference notes that information and debriefing cannot be equated with true consultation as enshrined in the principle of social dialogue embraced by the structures of the European Union. Aware of such shortcomings in the consultative process leading to the formation of educational policy, the General Conference appeals to the Education Authorities to adopt a participative consultation process as opposed to the current top-down approach.

4. MUT College Delegate

The Union shall endeavour to enter into negotiations with the Education Authorities in order to establish the role of MUT College Delegate provision for which had already been made in the MUT Statute during the MUT General Conference of 2008.

The Union insists on implementation of the College Health and Safety Representative clause established in the 2010 Agreement. Further, the Union shall endeavour to extend this provision, already enshrined in legislation, to other educational establishments.

7. Restructuring of the MUT into membership section

The General Conference urges the MUT Council to study ways and means for eventual restructuring of the Union's structures in order to better reflect the number of members and different sections they hail from and to enhance efficiency and service.

The MUT Triennial General Conference will be held at Le Meridien Hotel, Balluta on the 30th May 2011. Foreign speakers have been invited to deliver keynote presentations. More details, including the Conference programme will be issued in due course.


AMENDMENTS TO THE MUT STATUTE AND MOTIONS FOR APPROVAL BY THE GENERAL CONFERENCE

The MUT Statute provides that the Council of the MUT and MUT Delegates in Schools may present Amendments to Statute and Motions for approval by voting during the General Conference.

The Amendments to Statute and Motions of the MUT Council for the General Conference have been drafted and are being reproduced below. Delegates may propose Counter-Amendments to the Amendments and Motions being presented by Council.

Moreover, MUT Delegates may also wish to submit Amendments to Statute or Motions on behalf of their members at School.

Any counter-amendments, counter-motions as well as amendments and motions, signed by the School Delegate and seconded by MUT Committee/MUT members at the school are to reach the MUT Secretariat (attn. Ms Doris Camilleri by mail or electronic mail (info@mut.org.mt) by not later than Wednesday 20th April 2011.

Amendments to Statute

1) To Amend:

Council 16 (h)
Any member of the MUT Council who becomes a full-time official in the Confederation of Malta Trade Unions will be required to relinquish his seat on Council until such time as he/she is performing duties with the Confederation.

Any member of the MUT Council who becomes a full-time official of any Confederation of Trade-Unions will be required to relinquish his seat on Council until such time as he/she is performing duties with the Confederation.

2) To ADD Clause and AMEND subsequent numbering:

79) Legal Services offered to MUT Members:

1. MUT members shall be entitled to free verbal legal advice on any matter.
2. Fully paid MUT Members shall also be entitled to free legal representation on issues whereby they:
a. are affected by a clear breach of a collective agreement signed by the MUT, and/or
b. are facing disciplinary procedures that may lead to dismissal, and/or
c. need legal representation on the Industrial Tribunal on issues as listed above related to their employment within an education setting.

Further to sub-clause 2 above, the MUT Council may consider the granting of free legal representation to members on other issues related to employment that are not listed above.


3) To AMEND Council Clause 16 (e):

4) ADD: SECTION XV:

MUT YOUTH SECTION

81 The MUT shall have a Youth Section as per provisions herein established.

(1) Recruitment and elections of MUT YOUTH Section Committee members

Young MUT members who are between 18 and 35 years old and who pay their subscription fee regularly are eligible to join the committee. A call (for nine members) will be made in conjunction with the MUT Council Elections or when the MUT Council deems fit for the interim period. A nomination form will be made available online on the MUT website. A hard copy of the nomination form will also be sent to members through a letter circular issued to schools and other educational institutions by the union. Duly filled nomination forms can be sent by post to the MUT or delivered personally by hand or through the union delegates/representatives.

An electoral board which will be appointed by the Union will process nominations and hold an ad hoc election if applicable.

(2) Composition of MUT YOUTH Section Committee:

" MUT Youth will consist of a maximum of eleven regularly paying MUT members;
" The term of the committee will be three years;
" Committee members will be aged 18 to 35 years old when they are nominated;
" The committee will be composed of a chairperson, a deputy chairperson a secretary and eight members;
" Up to two MUT Youth members will be nominated by the MUT council. At least one of these members will be required to assume the role of either the chairperson or the deputy chairperson of MUT Youth.
" Other members of MUT Youth will be nominated and seconded by MUT members;
" An election for nine committee members will be held if the number of nominees (except the two members nominated by the council) exceeds nine;
" If applicable, elections will be held simultaneously with the MUT council election,


(3) Aims and Objectives of MUT YOUTH Section:
" empower young union members
" rally young members with a common interest
" magnify young members' voices
" share young members' experiences
" contribute to a smooth school to work transition
" enable young members to access the union structures
" critically and constructively think about, debate and bring forward important issues
" put forward the benefits of a trade union membership
" organise young members at the workplace
" ensure that young member's issues are reflected in trade union policies and programs
" co-operate with other unions and organisations to establish good networking
" provide special services and publications for young members
" be an initial spark for new union initiatives


Council Motions:

1. Funds and Research:

The Union Council, under the guidance of the MUT Treasurer, will endeavour to seek methods of tapping European funds for research purposes with the objective of embarking on research projects which can help shape and guide Union policy on matters that concern the MUT.

3. Consultations with the MUT:

The General Conference appeals to the Education Authorities to practice the principle of social dialogue at all levels and stages of policy making. The General Conference notes that information and debriefing cannot be equated with true consultation as enshrined in the principle of social dialogue embraced by the structures of the European Union. Aware of such shortcomings in the consultative process leading to the formation of educational policy, the General Conference appeals to the Education Authorities to adopt a participative consultation process as opposed to the current top-down approach.

4. MUT College Delegate

The Union shall endeavour to enter into negotiations with the Education Authorities in order to establish the role of MUT College Delegate provision for which had already been made in the MUT Statute during the MUT General Conference of 2008.

Circular No. 2/2011:

The Education Reform is round the corner. As a member of the teaching profession/educator do you feel you have been consulted? Do you have any concerns which you wish to share with Union Officials and your colleagues? What is your opinion about the College System? What is your experience of mixed ability classrooms? Do you think that the intended reform will on the whole benefit our students?
In view of these and many other important questions being raised by educators, the Malta Union of Teachers is organizing a FORUM for ALL TEACHING GRADES on the 23rd February 2011 between 4.30pm - 7.30pm , The Teachers' Institute. Refreshments will be served.
Participation of all teaching grades is being solicited. The Union will collect all the feedback received in order to give voice to teaching grades' views and concerns with the relevant Authorities and with the Media.
  • MUT COUNCIL ELECTIONS (2011-2014):
    The MUT Council Elections for the period 2011-2014 is fastly approaching.
    The MUT Election Board is hereby attaching Election Circular No. 1/2011 for your attention.
    As per MUT Code of Rules, all MUT Members who are fully paid up are entitled to vote and contest the Election. In this respect, we solicit all MUT members to regularize their subscription and urge those members who believe that they can give a valid contribution to the MUT to contest these elections. As indicated in the Circular, the Nomination Form may be collected from the Teachers' Institute, by phoning or downloading from the MUT website.
  • COLLECTIVE AGREEMENT FOR PUBLIC SERVICE EMPLOYEES:
    The MUT is actively involved in the negotiations on this Collective Agreement, together with other Unions representing public service employees. Negotiations are still underway and hence the public service salary scales have not yet been established. Any increases on salary scales, once established, should be backdated to January 2011.
  • ASSIMILATION INTO THE KG GRADE:
    Following intimations of industrial action and intensive negotiations with the Education Authorities and officials from the Public Administration Human Resource Office (PAHRO) and the Public Administration Collective Bargaining Unit (PACBU), the Union has ascertained assimilation of Kindergarten Assistants as per provisions of the MoU on the KG Grade (signed 26th May 2009) and the Education Agreement (signed 23rd August 2010). The Union is closely monitoring the assimilation process of the KG concerned who have completed the requisite course for this assimilation.
  • SUPPLY CATEGORY WITH OVER FOUR YEARS SERVICE:
    The MUT notes with satisfaction that after incessant appeals on behalf of supply teachers, supply kindergarten assistants and supply learning assistants with over four years service, nearly all of the employees concerned have received official confirmation of their indefinite status and commencement of progression on their relative scale. Any members in the supply category with over four years service and who have not received such confirmation are urged to contact the Union.
  • ITS AND MCAST COLLECTIVE AGREEMENT:
    The MUT is in the process of negotiating a new agreement for the Institute of Tourism Studies. The Union has already made preliminary meetings with its Delegates wherein an initial Draft has been formulated and submitted to Management to serve as a base for negotiations. Similarly, the Union is in the process of finializing a Draft Agreement with its Institute delegates to serve as a base for negotiations with MCAST Management.
  • MUT MEMBERSHIP FEES:
    All Members of the MUT are urged to keep up to-date with their subscription fees. Members are advised that legal assistance and voting rights are subject to having your membership fully paid up, as per MUT Code of Rules.
